    Child Custody & Visitation

    In family law, child custody is one of the most disputed issues for parents. When parents decide to get a divorce or split up, it can be difficult to agree on who has primary custody of the children and the visitation schedule that works for both parents.

    At Mlnarik Law Group, our attorneys will advocate for you and your children’s best interests. We recognize that prolonged child custody battles can result in further suffering to parents and their children.

    To avoid trauma from drawn-out custody battles, we work with your ex-spouse’s attorneys to determine the best child custody agreement.

    If both parents can’t come to an agreement on a parenting plan, a family court judge will make the final decision at a court hearing. In the California family court system, there are 2 types of child custody orders:

      1. Legal custody (joint or sole)
        Determines who makes important health care, education and welfare decisions for your children.
      2. Physical custody (sole/primary)
        Determines who your children live with most of the time.

    Child Support

    Once a parent has established primary custody of their child, the court may order the “non-custodial” parent to pay a specific portion of their income as child support.

    A non-custodial parent is one whom the child will not primarily live with. If neither parent has custody of their child, the court will order both parents to pay child support to the third party who has primary custody.

    In California, child support cases are often very complicated and can be confusing for parents.

    Restraining Orders

    Also known as a “protective order,” a restraining order is a court order created to protect someone from being physically or sexually abused, threatened, stalked, or harassed.

    The “protected person” is classified as the person applying for the restraining order, while the “restrained person” is the one whom the restraining order is applied against.

    At Mlnarik Law Group, we provide legal consultation and guidance for the following 3 kinds of restraining orders:

    1. Personal conduct orders: orders to stop specific acts against the protected person in a restraining order.
      E.g. contacting, attacking, stalking, destroying personal property, disturbing the peace.
    2. Stay-away orders: orders to keep the restrained person a certain distance away from the protected person.
      E.g. away from their home, work, vehicle, children’s schools.
    3. Residence exclusion orders: orders telling the restrained person to move out from where the protected person lives until the court hearing.
      E.g. domestic violence or adult abuse restraining orders.
